£10 extra charge for no return of paper work

i have a insurance policy with mini bus direct for my mini bus... they use a finance company to collect the monthly payments....

they have added an extra £10 charge because i have not returned the FIXED SUM LOAN AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974

they do state in small print that a charge will be added for non return of the paper work!!

although, i have not yet signed anything to agree with them to take money it seems unfair! but is it legal?

any help greatly appreciated thank you...

Have you read the contract recently?

ye iv read it as i said i does state in small print they will add the charge but just didnt seem very fair!!

Small print in a contract does not count as it is not full and fair disclosure.

So, they don't have any legal standing.

so in that respect what can i do from here? can i claim the money back at all? as they have been taking an extra £10 a month since December and i have only just noticed on my account..

I would still need to see the original (or your copy) of the contract. This might help us more.

Sometimes the easiest thing to do would be to cancel the thing and start again. Is that an option? Afterall, the tenna might be just a penalty for that one issue!
