Postby paul kavanagh » Mon Mar 05, 2012 5:17 pm

hi everybody, newbie here. have been watching john;s vids for a while now. i always promised myself, the next time i get a minor driving offence ticket, i would challenge it. well it has happened. i am in the habit of removing my seat belt as i drive into my estate where i live. and who is sitting at the lights coming out, yes, the police. they turned around and stoped me. gave me a fixed penalty ticket £60. not sure what to do now. can anybody help. :D

Pay

surprised you were not caustioned there and then told to get in the police car then being unable to leave were giving a ticking off as if you were a school boy.
I was done like you in the North East £60 to pay ( he said we are having a purge on individuals not wearing a seat belt they need money as the Police are a Corporation ) he said anything you say will be used against you as evidence blar blar blar.

Not wearing a seat belt is a Statute introduced by Parliament, the Labour party introduced / Gave us 1500 acts statutes while in Government in 10 years all in the name of DEMOCRACY MIND YOU Parliament has been giving us acts, statutes since before 1666.
They hastily introduced acts, statutes to STOP THE ENGLISH FROM HAVING A REVOLUTION like the French all under the name of democracy

The statute doesnt say its mandatory to wear a seatbelt, but "appropriate" to do so. On that basis people are getting done left right and centre, with possibly all taking the fixed penalty though they havent broken any statute.

Easy, dont pay it.

Ive got an "anticedent" (?) for not paying a fine which the PF presumed I was due to pay, totally ignoring my reply to their notice. The police dont seem to give a shit about it and I presume it will just sit there in limbo forever because they refused to take it to court and didnt get my agreement to pay a fine for objecting to big brother like antics at a rail station. Im not sure if the same will apply to fine under the RTA since you likely signed up for a driving licence. Id definitely research the "appropriateness" of seatbelts and see if you can find any caselaw on the matter.
