Update: New letter received from DWP...

About your appeal

You recently lodged an appeal to the Tribunal. The office that made the decision you are appealing against has suggested that the Tribunal cannot hear your appeal. It is suggested that the Tribunal has no power in law to rule on the decision you are challenging.

I would be grateful if you could let me have your comments on this question, in writing, within 14 days.

Please note if you do not respond to the Tribunal within this time, the Tribunal Judge may bring your appeal to an end.

So there basically saying theres nothing she can do?

I didnt know that, she had an appeal form sent out to her which i filled in stating the social security act and highlighted the part about benefits being inalienable from charges. That was the reply she received.

Thanks Forestnymph, she rang the job centre and asked for an appeal form and they posted it. Iv allready spoke to someone from wellfair.org and they suggested.....

"The deciding office can only suggest their opinions because they cannot make a ruling proper to the tribunal. If the tribunal has no power in law to decide this, it is for them to decide, not the original deciding office. Also, if it is beyond their power, the matter should be referred to the appropriate/higher authority - poss the commissioners?"

Well, so far so good. Shes not a heard a thing from them as of yet and so far there have been no deductions. Will keep you updated if anything changes. Thanks again

update:

I refer to your letter asking for comments regarding the submission made by the above named appellant about the amount of deductions the DWP are making from her weekly entitlement to income support. These payments are being made to yorkshire water to clear arrears which have accrued on her account.

you ask for an explanation as to why there is no appeal against this deduction.

in accordance with regulation 27 of the Social Security and Child Support (Decisions and Appeals) Regulations 1999 there are certain decisions to which no appeal to an Appeal Tribunal lies and Schedule 2 to this Regulation lists those decisions. Paragraph 5 (t) of that list refers to Regulation 34 ( decisions by the Secratary of State or the board as to paying another person on beneficiaries' behalf)
The Water Company fall into this category.

The reason why Ms ***** has had the deductions made from her weekly entitlement was because she has provided evidence to confirm that her Water Account is in arrears which if not paid could result in her water supply being affected which in turn could be detrimental to her health and well being. Consequently it is a requirement of the DWP to make sure such deductions from her weekly benefit to be paid to the Water Company.

Consequently the DWP now request that you treat Ms *****s letter of appeal to be outside the Tribunal Jurisdiction and advise us accordingly.

Accompanying this letter was another....

The law says the tribunal does not have the power to deal with the decision you are appealing against.

This means the appeal has been brought to an end.


Could anyone offer some advice on the next step or is this game over?
