court summons for speeding and failure to name driver.

my partner today has recieved 2 summons for speeding and failure to name the driver - which we cant do as we dont know who it was on both occasions. i replied to both the s172 NIP asking for photographic evidence and by saying that it clearly states that its a crime to knowingly furnish a false statement, on receipt of the photographs it is impossible to identify the driver each time, on both occasions we were celebrating at our house and have been as diligent as we can in attempting to discover who was driving but no one has admitted to it. however now they say in the summons that they are trying to prosecute for the speeding offences and the non naming offence (a total of 12 points) - and she isnt guilty! any information on out next course of action would be massively appreciated. thanks in advance.

Yes......On this particular issue,I would strongly recommend getting yourself over to Pepipoo.....www.pepipoo.com . They are the real experts on this sort of stuff !! They will disect it to the enth degree !! ;)

lol playing this game aswell waiting for me cort summons for 12 points for a potential 6 month ban
when all totaled up ill have 21 points if i admiti was driving
what i did do is sent a letter back with the disclosures yup 3 off em with a note saying i cant admit it was me driving as they are pool cars
and cant name anyone else who would drive them as dont have access to the records .so if i say it was me and it wasnt then i would be lying
on your official papers which is a criminal offence and not being a criminal i cant commit to any lies


have left it in there hands still waiting for a reply

If you want to play them in their own game then check the cameras were regularly calibrated and ask for the details and reports of the calibrations and dates. What was the limit and how over were you? Is the area clearly marked with the correct road signs? If not are the lamposts a set distance apart indicating a 30mph limit? What time of day was it? Was the traffic heavy or light? Gather as much info as you can and do your homework.
Personally I would just allow them to fine me and wait for the charge notice then send a conditional offer of acceptance followed by an estoppel. I've used this method twice now and it worked both times.

only the named insured drivers can be named or they will ask you to provide the insurance of any said named driver, if you fail to give the named drivers insurance details they will hit you with 6 to 8 points and a £525 fine. IN14 will be the penalty on your DL for 3 years,
