its mad how you need tax mot ect ''so they say''
if i took that in for an mot they would start laughing saying dont think so.
plus if i took it to get road legal they would say dont think so aswell.
its a kids electric bike with no engine, its just that it looks like a bike with an engine and it fooled the police so hes fooling me by getting points on my licence and getting me fined the bell end. i explained look its a kids bike no engine i put throttle on and with no noise at all the back wheel starts spinning fast,even his police mate who he was with was willing to let me go i could see it in him that he knew his bastard copper mate was being a c**t.
i dont paint all police with same brush as you get police that actualy do there job proper.

Im sure theres some distinction between a thing powered by an engine and something powered by a battery but Im damned if I can find it. Ive been to the Road Traffic Act 1988, Road Traffic Refulations Act 1984 and the Electrically Assisted Pedal Cycles 1983 and Im at a loose end. Whatever the distinction is, it has the effect that an electrically powered vehicle would be treated different depending on whether it has a generator on board or if it needs charging at the mains. So far I cant find it and I dont know where next to look. Also cant find a definition for "mechanically propelled" because even cycles are mechanically propelled if we are speaking english rather than legalese.

What's the offence they suspect you of (ie the statute and section).

freeman stephen thanks for doing research for me and i can see this site is very helpfull with many people helping in many different ways.
ive also found theres no legal definition on machanicaly propelled aswell.
can it get ajourned or will it get delt with on the 23rd when i go.? (whhat do you think)
i will keep you informed and love all you freemen out there that follow common law, it should be called common sence law i think haha

If it were meant to have an MOT should it not have been supplied with 3years cover buy the dealer? also you can’t get insurance without an mot.
This is NOT a mini moto, it’s clearly a toy, this is about you riding a toy on/across the road, and does it have keys? How would you turn on/off this toy, could you friend not be a witness that you were ‘freewheeling’ if that was the case lol, I mean how can they say you were operating this toy ie no sound, take a photo of it and go to the local papers, this is absolute bonkers…

I think the judge will either tell you to get a lawyer and come back or will throw the case out. see about compensation for your time and worry at the moment its thrown out because this cop likely sees dragging you through court as a form of extra judicial punishment if can meet out whenever hes in a bad mood.

Yes and when the case does get thrown out (as it surely must ?),I would be looking into suing the stupid and vindictive cop personally for 'malicious and vexatious' prosecution and mis-use of his office !! (The courts and lawyers like to throw the 'vexatious' word around.....makes them feel all self important...lol). I would certainly be putting in a claim for expenses,loss of earnings etc...... They will do it to you,so......
If this doesn't get thrown out,then this country is more f***ed up that I thought ! And given my experience,that is really saying something !! :x

this site is very helpfull and i thank you all for your replys and info.
the bike is now actualy sold as its more trouble than its worth as my lad got told to take it home of the plastic police as he had no adult watching him on it they said.(my lad was with 2 14 year old cousins and friends)
im just going to hope for the best at court and run the trail on my own (not allowed solicitor) but im not going to give in and im going to do my best.(ive wrote loads down to point out)
so i can actually get the police man done if i get not guilty?? that will be decent that as he as caused me stress.
the police man is going in court and the judge is going to go just of his witness statment as evidence,he as no bike and no picture of the bike,even tho he should of impounded the bike for no insurence??

i cant get done on assumence right?? are we not guilty untill proven guilty?? surely the police cant say something was something and not produce evidence and get a conviction on what ever they say(hope you no what i mean)

23rd of this month the trail is,i will keep use guys informed

This may sound a really stupid case that should be thrown out of court but i wouldn't get your hopes up as we no longer have courts with any sense of compassion, morals or logic. In the last five years typically the courts will convict you if the paperwork can stick as its a 100% administrative process! YES you are already GUILTY and the only way out is a counter claim or luck on a technical issue. There are other ways but it means years of training and be prepared to file tons of paperwork and take it up to higher courts. You need to fight back in Administration and question the jurisdiction. By this i mean not of the court but your position as not a fiction and not party to the statutes because unfortunately right now you are 99% already guilty. The court already took place at the road side and the magistrates are making the hearing to fix the fines and they are NOT there to hear debates, morals, logic or common law excuses.

As your new to this you will not be able to do this successfully without arguing and arguing will get you contempt of court.

If people can be fined for dropping "sweety papers" or cheese-puffs on the street etc then being caught riding on the road on a child electric bike is not a good situation. BTW to be classed as an "electric bike" it MUST have working pedals else its classed as a propelled vehicle. This is why kids electric scooters of the stand up type no seat will get you in a whole lot of trouble even if it only goes 10MPH. Some people have been found drunk in charge of push bikes riding home 100 yards from the pub and lost their licence as a result. There was a case couple years back of a dad riding his kids battery powered toy truck up the pavement 6 houses away from home and also got fined and 8 points.

The fact you no longer have the bike may be seen in your favour as far as the court is concerned. If you are lucky don't be surprised to get an £80 fine and £30 court costs because they WILL get something out of you to make the "legal robbery" worthwhile but they might drop the insurance charges and leave your license alone.
