i just had a visit from marstons bailiff who made sure i will come to my door to open it by kicking my door aggressively. as I have read on this forum as on others, administration act, debt collection guidelines etc. if the bailiff kicks my door to gain entry, or to notify me to open the door to him by kicking my door in it ds not qualify as peaceful entry or does it?
basically there was a court fine of 85 pounds issued against my boyfriend and he had no money to pay it at all. few months later we got a letter from the court than from marstons and we had the money so he paid it. marstons now on top of that demanding 300pounds and claims they can get him arrested cas the bailiff has got a warrant to do so.however we have not seen any id or warrant only the piece of paper produced by marstons.
we have paid the fine and I am willing to pay an extra 40 pounds for admin fees if necessary, but not 300.my question is wheather they are allowed to kick my door aggressively, and if not what can i do as he says he will not accept token payments. also can/do they have the right to arrest a person if court fines paid but bailiff charges are not?
