can marstons kick my door?

i just had a visit from marstons bailiff who made sure i will come to my door to open it by kicking my door aggressively. as I have read on this forum as on others, administration act, debt collection guidelines etc. if the bailiff kicks my door to gain entry, or to notify me to open the door to him by kicking my door in it ds not qualify as peaceful entry or does it?

basically there was a court fine of 85 pounds issued against my boyfriend and he had no money to pay it at all. few months later we got a letter from the court than from marstons and we had the money so he paid it. marstons now on top of that demanding 300pounds and claims they can get him arrested cas the bailiff has got a warrant to do so.however we have not seen any id or warrant only the piece of paper produced by marstons.

we have paid the fine and I am willing to pay an extra 40 pounds for admin fees if necessary, but not 300.my question is wheather they are allowed to kick my door aggressively, and if not what can i do as he says he will not accept token payments. also can/do they have the right to arrest a person if court fines paid but bailiff charges are not?

What you are describing is out and out looting sponsored by the state. This is not just happening to you but is happening on a mass scale in this country.

There are people online who can help, google. BaliffAdviceOnline (or some such). It sounds like you are trying to get the extra rip-off charges that have been added (without any court order) set aside on the basis that you paid the original amount.

If they come to your door again get them on camera or even better on video.
Remove their implied right of access
Report Marstons to your council for harassment (a female only option).

hire a security guard ..and no they cant kick your door phone the policy enforcers and give them some shit like theres a crazy fu cker trying to kick in ya door and you are fearing for your life ..tell em to fu ck off i did and it worked even with the enforcers there with them..but then i am 6ft tall and weigh 17 stone and us to bend steel ropes for fun "world record breaker" oh and i was one of the best in the world lol but hey its all good lol i was the one of 3 to make the last hand made torpedo net in the world
and the largest blast net in the world .anything to do with steel ropes ive done all over our world ..so fuck the bailifs

hi hurn, nice to meet you and congrats for your achievements they are impressive . my boyfriend want to kick their asses so he wud gladly join you i suppose lol.

but to be serious now. where can I find information on whether the bailiffs and HCEOs can/have to accept long term payments or not, cas I have got one attempt just refused. i know that creditors have to accept token payments if I prove them I am in hardship, but as i have learned the bailiffs seem to work on completely different statutes..-well they seem to think so. am pretty sure they have to accept whatever payment I can make but i might be wrong. any advice on this please?

1)no they cant kick ya door this would be criminal damage ,report it to the courts
2)do you have the reciept for the paid fine .if so tell them to take you back to court the maj will slap the bailifs arse
3)they cant get him arrested they are using scare tactics,try and record everything ,if they see this there attitude changes
4)the bailiffs costs arnt enforceable if you prove they are over the top
5)send them a bill for damage to your door and for your distress and anguish through all the farce

Interesting Thread This is. Marstons/ Other DCAs, are not entitled to Visit your House, Work Premises, or Even Contact you without Prior Appt ( EG By Arrangement). And as this is never going to happen, for the The following Reasons

A)They have no call on you ( its a bit more complicated than that)

B) You don't owe 'THEM' anything

So, if they have overstepped the mark, Yes you can Report it to the Courts, However doing this on its own, is not sufficient, But if its Backed up and Substantiated by a Crime Number, then it will carry far more weight, than simply being reported direct to the court.

DCA's can be Seen off With a Very Simple procedure, proven to work, so that they don't 'Bother' you anymore & Which carries Far More Weight, than Reports to Police Ever Will.

hi Dave nice to hear from you. we went to CAB earlier cas we are fed up with marstons and jacobs and the rest and we have been told if it is criminal law we have no chance to even ask for a small installment repayment cas they do not have to negotiate and we shud let the bailiff to come into our house and seize things.

i am struggling to believe that if a person has no money they can just walk over you. there must be something we can do.....

do you know by any chance if marstons have any ccj against them?and if its truth if they do they are not aloud to enforce anything.

happned to me, broke in with lock smith, no offical court warrent, since counter claimed, no proven debt, did AFV and on b gas lts froced meter on me, now shows no debt, i did all correct manner and counter claim now for stolen top lock on door and key on bottom lock and damge to door, nd i have sister on loud speaker all the while did witness statement, police do not come when i called 999 being bed bound, no carers till later, all men, alone, they froced unlawfull entrey, i never had lawfull invite to defend any court case, as no ref number, never been produced, and all lies, to bil nd froce thier demands, knowing i not able to blot inside as carers use a key safe, thye wanted the code, its not owned by me, so no consent, did a;l diene acess, and on door to, so now i try refund all costs for damges and for stolen lock and damges to bolt lock and key, complanit to head office, too, i bet i get no answer, so i counter offer, via poster order, only when thye lawfully prove, my natual perosn, is libel for thier claims, i offer for lawfull use of what i only able to , so worth a try,
