Affidavits and Statutory Declarations

Postby john10001 » Mon Aug 10, 2009 10:59 pm

Can anyone tell me if you have to read out your Affidavit out loud in front of the solicitor and if not what about a Statutory Declaration? Or do they just simply witness your signature and then sign and stamp?

My affidavit is now ready to roll and send to HM, am going to solicitors probably tomorrow or Wednesday to do it. Just wondering what process is now - just take to solicitors get signed and stamped. Take home, make copies, post off registered delivery to Buckingham Palace right?

Also have a Statutory Declaration Confirming Identity and Nationality to try and get company I work for off my back as I am unable to find the documents they're requesting e.g. passport, birth certificate as part of the right to work documentation they need for the Immigration, Assylum and Nationality Act 2006 check they are doing with all workers. Have worked there ten years plus and am British since I was born! Will get disciplined aparently if I don't get them this week and probably suspended or fired by the sounds of it. I'm hoping stat dec will be enough and take liability away from them to me? I may be able to find something from a govt dept if I have a route around eg P60 but I'm sure all this info comes from company I work for anyway and they already have all my NI info from whenst I first started working there else deductions for tax and ni wouldn't be coming out my peanuts. Arggghhhhh! :x

Thank you,

John

I really hope you are not relying on this document to clear up these issues.

I feel your company will not accept a statutory declaration or else they would have asked for one alongside the other paperwork.

Hope things work out for you though

In answer to the OP's post and question, some solicitors just require you to swear on the bible and say that your affirdavit contains what you believe to be true, then you sign it, the solicitor then signs as witness and dates it and places the firms stamp upon it.
As regards your firm, i would ask them that if they aren't sure about the legal document that you have handed in or its validity then tell them to take it to their legal department to have a look at it.
Jargon it may have been more helpful to post an answer to the questions rather than give negative opinions, which you seem to do a lot in your posts of late, you don't offer a solution just negativity about the freeman way, is this really helping anyone i wonder, just an observation on my part.

If you are confident in their understanding and the reasons why you have chosen to do what you have undertaken then the answer would be yes, only you as an individual can know when you are ready,

Tigs,

I went the stat dec route. They haven't come back to me so hopefully that has been good enough for them and will keep them off my back. I don't think they liked it each time I kept asking them "what law" obliges me "what law". I've never seen so much squirming, trickery and complete avoidance of the question. They tried switching it to "company policy" instead of anything to do with the law. I think they had been heavily briefed by the legal dept on what to say even though they had previously said they have to in law!

My stat dec and affidavit didn't have the firms stamp on they just wrote the address, and filled in their details. I had to read a bit of the beginning and the end of the stat dec and affidavit (if I recall correctly) and swear/affirm that everything was true within it before signing and solicitor also signing.

Cheers,

John
