Speed cameras and how to deal with "fines"

Postby nomadrush » Mon Sep 14, 2009 9:35 am

I have had four speed camera encounters in recent years, and have walked away from each one with no fines and no points on my licence and here's how you can do the same......

1. Like all corporate bodies, they have an income v outgoings budget which means if it costs them over a certain amount to pursue you, they have no alternative but to drop the matter, so point one, is write back to them, and keep writing back to EVERY response with another question!

2. Ask for the camera's "Certificate of Calibration". They will write to you and tell you the camera is "auto-calibrated". This is bullshit as it needs a human involved to test and approve the calibration therefore no camera can be legally "auto-calibrated". So write back and refuse their explanation on these grounds and again demand a current certificate of calibration. (This advice was given to me by a solicitor and confirmed by a friend who works inside the court system!)

3. If you are caught by a "mobile" speed camera, write and ask again for the camera's certificate of calibration, and then in your next letter, tell them you believe the camera operator was moving and that the camera was being "panned". Evidence has shown that if the camera is moved even slightly it can clock a brick wall doing 30 mph!! If they continue to pursue you and threaten court action, inform them that you will require the camera officer to be present in court for cross-questioning on the panning issue. This way they will have to fund the officers wages whilst taking him "off the road" for a day. Usually the case will be dropped at this stage as was mine!

4. NEVER fill in the forms they send you asking for you to confirm your name, address and date of birth and do not sign these forms. Many people do this so that they can fill in the "mitigating circumstances section" but once you do this, you have entered into their contract and thus joinder.

Remember, the more letters you write, the more they have to reply which takes manpower, time and direct costs to them. They are a "for profit" company making money out of you for themselves and the government, don't get sucked in!

Hi guys,
I have recieved A NIP from north wales police dated the 18.09.2009 stating that on the 19.07.2009 at 08:20:55 I allegedly did 42mph in a 30mph limit, I have received no NIP until today 23.09.2009 and I am considering draughting a letter stating as such, but in an adjoining questions sheet one of the questions is,

Q. Why did i recieve this notice outside of 14 days?
The initial notice was sent within 14 days to the Registered Keeper
with DVLA. However, this ruling does not apply to any subsequent Notices.

My question is do I still contest the 14 day NIP rule or is this statement their get out clause or are they just using more empty words to bully me, should i go straight to asking for the "Certificate of Calibration"

Any advice on the above and on how to draught a letter would be much appreciated, I am new to taking action but myself and my parents have been bullied by these corporations in the past over parking/speeding fines.

Peace and love Dave.

Re: Doc ref number, Notice number, date of NIP, date of alleged offence etc
NOTICE OF INTENDED PROSECUTION

Acting Chief Constable Ian Shannon,
Central Ticket Office,
PO Box 53,
Prestatyn,
Denbighshire,
LL29 7WW

Dear Sir,
I have recently receieved a NOTICE OF INTENDED PROSECUTION from your office, I gather (instead of understand or does this not matter)that unless I recieved the NOTICE OF INTENDED PROSECUTION within 14 days of the alleged offence there is no case to answer.
The date of the alleged offence was the 19/7/09 at 08:22:55, I did not recieve the NOTICE OF INTENDED PROSECUTION until the 18/9/09, I would assume that this would bring an end to this matter.

Yours Sincerely (my name)

Any help would be much appreciated, I know that you guys are all frying bigger fish, this will give me the confidence to really start causing problems for the establishment, I already tell many about your site amongst others.

Many thanks Dave and family.
PS Peace and love.

Hi,
I am new to this site, it was recommended by a friend here in newcastle whom is always reading up on these matters.
I have received an NIP for doing 35 in a 30mph. I wasn't stopped and there was no visible police officers with a gun and there are no speed camera's on the road i was allegedly caught on. I have recently been convicted for speeding so have been driving very carefully. Is there anything i can do as i believe that the law is now just thinking about lining it's pockets rather than trying to prevent and fight real crime. Any advice is greatly appreciated. PS I also have 7 points on my license now thanx to just following the system.

Also when I got my 1st 3 points on barrack rd for doing 36 on a 30 in june last year and a few days ago again driving at the speed limit on the same rd i was overtaken by a cop car that was doing at least 40 which did not have it lights flashing or anything, it cheeses me off that they penalized me with 3 points and a hefty 60 quid fine, especially when i found later that they could have offered a speed awareness pgm as it was my 1st offense. And these are the ppl that are supposed to uphold the law - hypocritical!!!

I have composed the following letter and now just need to send it and if there is any advice on how I can improve it or anything i need to delete or add plz let me know asap as I will post it on mon/tuesday coming. I will also keep you all updated as to what happens.

Dear Sir/ Madam

I am writing in response to the NIP I received on the 23.09.2009.
I would like to request any photos or any other literature in regards to the offence.
The letter also states that the driver was doing 35 in a 30 mile an hour road. I also do not believe this to be accurate as i now always stick to the speed limit so I would also like any evidence to say that the driver was doing 35mph and what sort of device was used to record this, whether it was a stationary camera and if not then details from the police officer of the type of device used, if this had been calibrated, if so then when was this last done and also what sort of training the PO has in using this device.
The offence was recorded at 12.41 on 13.09.2009 at a189 haddricksmill road south gosforth.
and was signed by p oliver on behalf of the chief constable

many thanks

sorry mate but that letter will get you 6 points and a fine upto a k

if you are the RK you need to exercise reasonable diligence in finding who the driver was, i dont know, doesnt work and they will just summons you for failure to furnish

i know i tried it

it used to work about 6 years ago but not any more

i know im prob waiting my time and youl do it anyway, but at least il know i tried

nb the advice above about them failing to send the camera operator to court does work( sometimes ), but you need to know quite a bit about court procedure to carry it off

Dear Sir/ Madam

I am writing in response to your NOTICE OF INTENT TO PROSECUTE served on me on the 23.09.2009.

As I am not sure who was driving the car at the time stated I would like to request any photos or any other literature in regards to the offence.

The letter also states that the driver was doing 35 in a 30 mile an hour road. I do not believe this to be accurate as everyone who drives the car strictly follow the speed limit so I would like any evidence to say that the driver was doing 35mph and what sort of device was used to record this. I would also like to know when this device was last calibrated, if indeed it has been, and if not a stationary camera to know what training or experience its operator has had

The offence was recorded at 12.41 on 13.09.2009 at A189 Haddricksmill Road South, Gosforth. The NOTICE was signed by P Oliver on behalf of the Chief Constable.

Many Thanks

Ive never did a NIP the freeman way but theres a glaring error in how you dont know who was driving it, yet you assume in the next sentence that it was you driving below the speed limit. Also I'm not sure if its maybe better to go for one solid defence than three at the same time (who drives, trained operator or decalibrated). This might be seen as vexatious. I hope others can offer more information about NIPs, because Im just spotting one or two things I think you should change just from what you've written, and I dont have any real XP in freeman NIP clobbering.
