consumer credit act claims

Postby skygypsy » Mon Oct 05, 2009 12:24 am

Hi, I need some help- I,ve paid for a company called 'Consumer credit auditing to challenge the legality of my three credit card agreements- that was a year ago and nothing seems to be happening.I,ve paid the min payments up until july - I have received numerous letters from the credit card companies and endless texts and messages - none of which I have repied to. Would it be possible to enter into the statutary route of correspondence now, and if so could someone kindly point me in direction of which templates to use and there sequence? Would the fact that I have authorised another party to challenge the agreement prevent me from taking another approach?

If a default notice is issued doe's that alter the agreement in any way?

I also have a personal unsecured loan and overdraft - can I use any of the templates on these? and doe's anybody know if a mortgage can be challenged and written off?

Thanks-peace and light to all

You can enter the statute way of dealing with debt at any given point, did you pay any money to this company that you sought help from? you do realise that for £1 per alleged creditor you could challenge this yourself? A company serving you a default notice means nothing it is merely their process whilst you remain in dispute and aren't making the obligatory monthly payments to them, as per each statement that is.

this is the link for the first document you send any company that allege you owe them money to, all instructions are contained therein, however if you have any questions feel free to ask, i placed most of the debt templates on the 2 pages and i currently have 30 cases resolved with no money paid out to the companies in question, a further 20 almost reaching the same conclusion, and a further 33 over the first hurdle and gaining ground on the second leg.
Please also stop making your monthly payment once they have received your letter, you do not need to pay them anything further until they start complying with you!!
The thing that makes me suspicious of this company is that you have still been recieving letters and demands which you shouldn't have, you may find that you will need to contact the Trading Standards within either your area of their area and report this as they are not acting in your best interests at all, they need reporting,if you need further help, assistance or clarification of anything i have all laws and acts to explain the process entirely to you, please feel free to contact me via PM or here,i hate to see folk getting ripped off and the corporations getting even richer!!

Thanks for the reply, yes I paid over £400.oo to this company, all they seem to have done is write to my creditors asking for copies of the credit agreement - they have now refered it to a solicitor who is apparently acting on my behalf, all very long winded and no action!
