HSBC Bank Loan Advice Please

I have sent a leteer to the banksters asking for VALIDATION VARIFICATION COPY OF CONTRACT as the letter was written in template form I HAVE JUST RECIEVED THIS BACK FROM THE BANK

Thankyou for your recent letter blah blah blah
I note that you have not signed your letter and consequently we are unable to comply with your request. The Bank policy is to establish identity of the consumer via a signiture such that it can be compared with the signiture held on our records. We are not obliged to comply with a request unless we are satisfied as to the identity of the person making the request.

Therefore please re-submit your signed request to us whereupon we will be happy to proceed.

Please note to ensure that we carry out your instructions accurately, to help us to continually improve our service and in thr interest of security we may monitor/and or record your telephone calls with us.

my letter in case you were wondering was as follows..........................
WITHOUT PREJUDICE

With regards about my recent letter addressed to you with regards your claim against me
Could you please supply me with a Validation of the debt (the actual accounting).
Also i require a Varification of your claim against me (a sworn affidavit or i fact a SIGNED invoice)
As well as a copy of the CONTRACT binding both parties.

I would be happy to pay any financial obligation that i might LAWFULLY owe once these three documents are recieved

I have just read your post and you are quite right they are up to something...

If you take a look at my signature file, this is what I deal with all day long, I have some useful information to share ,which will crush that for you - without question.

Well after this unsuccessful post i have decided what to do ............... i have got a letter from them with the outstanding amount so i will A4V both the letter and the form that asks me to pay....... see what happens then cos they sent me another letter today which was doing all the threatening stuff like court summons bailiffs ect;........so thats what i will do advice or not Thaks anyway and i will keep you all posted regardless Best Wishes All

i thought more people would be interested in looking at this for you myself. seems to me that you've got a letter back with a remittance or statement requesting an amount of money. i'd send them another letter telling them that if they don't send you an invoice in according to the bills of exchange act 1882, a proof the debt ever existed, or a copy of the contract signed by both parties within 10 days bla bla bla.

They shouldn't need your signature to send your info to your address. I think they are up to something.

If they are asking for something with your signature on it, I wonder if they actually have your signature? When you applied for the loan, was it an "electronic signature" ?

If they don't have your signature, don't give it to them. I read somewhere that some debt collectors (not banks) have scanned signatures used them to forge a contract they could never have had.

Why dont you get your wife to sign your signature or change the way you sign.If they accept it you then you know that they have not got your signature.And if they send you some details with the false signature.Then you have got them.

could it be they want you to send your signiture so they can lift it? i have been adviced to put two straight lines through my signiture to stop them doing this.

You see i sent a letter on 16th april to skycard giving them 10 days to send me a signed bill for what they believe i owed them (paraphrased) that runs out sunday oddly enough.

Your said failure to provide aforementioned documentation within 10 days, to validate the debt, will constitute your agreement to the following terms: -

1. That the debt did not exist in the first place
OR
2. It has already been paid in full.
AND
3. That any damages I suffer, you will be held culpable;
4. That any negative remarks made to a credit reference agency will be removed;
5. You will no longer pursue this matter any further.

if i get nothing back by monday i'll consider the issue finished! They have sent the monthly statement to send back so that they can double dip for the final time :D but that's goin in the bin.

I think im on solid ground here. any contradictions will be considered part of the learning process and therefore welcomed.

Hi Mate
I got the same letter as you did and I responded with my signature will cost you 50,000 pounds sterling LOL and I have not heard from them since. What they are doing is lifting people signatures and putting them to the contract thus committing fraud. I know for certain that I signed no contract yet they are trying to argue that the application form is the contract and it is not. They can go and whistle, the one thing you must not do is put your signature to any correspondence with them. Providing you are sensible and stick to your guns they have no way of winning any case against you, then do what I will do hit them with a writ for Stress and Harrasment etc.
