Court questions..

Postby sabrim » Sat May 30, 2009 2:31 pm

Hi guys

when you receive a summons, do you need:

1) to reply it?
2) a solicitor ?
3) a affidavit?

or can you just attend the court and dismiss the case?

thanks

From what I've read (and I'm a noob so I'll probably be corrected on this).

A summons is an invitation to appear at a private court.

I no longer believe that solicitors have your best interest at heart, they are merely highly paid experts at operating in these private courts. I'm not sure you need a solicitor right now, if at all.

An affadavit is a statement of truth, I don't think that would be relavent at this point.

I think a reply of some type is the next step, can you elaborate on the reason for the summons then the more knowledgable people here may be able to help.

thanks guys :)

Unfortunately, i was cought travelling the ralway, having paid only for a certain distance

Of course I gave all my details to the inspector and signed his statement by the "stand-under" trick :( ...(frist mistake)
Weeks later i received a latter from Capital Connect to verify my name and adress, of course i ignored it due to my ignorance ..(second mistake)

Now I received a Summons letter, my name: capital letter, to appear on (The Court House, Clarendon Road, Watford Herts), with a case No which I am not sure if it is created or it would be created after my signiture..

do i need to reply to this letter or just attend the court and dismiss it?

cheers

Check chapter 5 of pdf! Although I would recommend you read the whole book a few times! chapter 5 deals with courts, lawyers, solicitors and court summons and how to reject court summons etc..!
