I asked the council wht are the bin men allowed to leave my bin right outside my door after collecting my rubbish, as this would be contrevening The Environmental Protection Act 1990 and the precise Section is Section 46, but i was told this:
I will pass this matter on to the refuse collection manager and ensure that the crews who operate in your area are given suitable advice about where they leave the bin.
I am not sure what point you are trying to make when you refer to Section 46 of the EPA 1990 – but I should advise you that this power is solely directed at householders. It refers to powers which exist to regulate the manner in which waste is presented to the Council. The placement of the bin on a highway is the responsibility of the householder and they should ensure that the bin is returned to their property as soon as possible after collection. The bin crews are not contravening any legislation by emptying the bin and returning to the footpath.
I will however agree with you that the crews should not place the bin in such a place as to cause undue inconvenience to the householder – I will ensure that your complaint receives the proper attention.
