There's been some great advice on this matter. Thanks alot. The fine is sixty pounds at the moment and three points on my licence which will put my insurance up. I was wondering though if I went to court and lost the case how much would I have to pay and would I be liable for court cost.

just because you signed the contract doesnt mean you are guilty, go to court and i bet you the two police officers are not there. they will be out looking for more mugs to fine, just tell them you wernt using it and the police made a mistake. then ask for the proof you were, you will be within your rights to ask. stick to your guns, good luck.

im sorry but this is one statute i agree with,

if your gonna chat on a phone get a hands free kit...

being a freeman is about taking responsability and controll of your life,

i dont have a hands free kit and i dont use my phone at the wheel. PULL OVER or WAIT...

i kind of agree with you there bones, just mind them pot holes and crap in the road, never seen anyone fined for that just yet.

This may be an unpopular response but you could have avoided all this trouble by not using your phone while you were driving. Some 'laws' are actually quite sensible. I think this is one of them. I've seen idiots trying to turn their cars around corners with one hand on the phone and the other on the steering wheel. They can't quite make it, so they stop in the middle of the road, back up a bit and continue, all the time with a phone stuck to their ear. This is just stupid and very dangerous. Talking on the phone while driving, even with a hands-free phone, is very distracting. Tests have shown that people's reactions are slower when they are on the phone. You should turn your phone off when you drive, for your own sake. With rights come responsibilities. Let's not forget that. We are the good guys. Let's be good.

I had a similar incident but for not wearing a seat belt. I was driving with a friend who wasnt wearing a seatbelt and we went past a parked police car who then chased after us with the blues n twos on, i pulled over and got out and the copper spoke to my friend who wasnt wearing a top as it was very hot. He didnt argue and admitted that he hadnt been wearing a seatbelt and got a fixed penelty fine. while we were there just chatting to the coppers they said he might have got away with it if he had been wearing dark clothing and had the window wound up as its harder to tell and i remembered that conversation when i was driving one morning and i had just forgot to put it on until i went past a police car parked up and straight away i thought shit, and put my belt on. When he came after me i pulled over and i waited for him to come over to me, and there i was wearing my seatbelt. He just looked at me and said "oh just put it on have we" and i just played dumb. He insisted that i hadnt been wearing one when i went past him. but bearing in mind what i had been told before and the fact that i was wearing a dark coat with the windows up early in the morning and he was parked up on the passangers side i knew that unless he had caught me on camera theres no way that he could prove it. I was expecting the usual have you been drinking lark just to be awkward but he just gave me the make sure you wear your seatbelt speech and off i went. He prob couldnt be arsed, and to be honest niether could i.
If they cant prove it and you know they cant then play dumb. Obviously with a mobile its a bit harder cause theres a record.
I have also read on here that you do not have to get out of your car or get into theres unless they intend to arrest you.
I have to agree with some of the answers here though that if you get caught driving on the phone you kinda do deserve what you get.
Same as if you have a crash while wearing no seatbelt. my fault if i go through the windscreen.

They will give you all sorts of good reasons for the fines but not the real one, its about cash, wonga, the lolly, the dosh.
If life and limb and cost was so great to our goverments then why do they sanction wars where they spend billions on arms to slaughter men women and children?
Dont f-ing kid yourself that seat belt laws, traffick laws are there for the good of joe public, they are there to get money PERIOD.

Cant you get away with it by saying you were using the car to assist your suicide, unfortunately you took the government propaganda too literally and really though it would kill you if you used a mobile phone. People should answer for this when we can even have our own assisted suicides properly conducted because of misinformation from the government. The sooner we have our verichips implanted the better, then the government will know we mean business because we will have our money firmly in our grip under our skin.

The mobile phone law is sensible for some but dumb for others, each case should be taken on its merits. Ive seen idiots trying to do corners with a phone in their ear causing all sort of mayhem behind them, and yes, do them. On the other hand, whats the problem cruising on the motorway while on the phone, even if some event occurs, you still have a hand free until your down to speed for changing into lower gear. Theres no safety concern with alot of mobile phone use while driving, but its a huge money maker for bored cops.
