FIRST RED CAR SEIZED

Ok, the first red car has been seized.

You know the tools I have available, how do I give them HELL?

(and no, don't bother lecturing me about whether I should of taken this course of action or any crap like that, the car is a pawn on a chessboard, nothing more.)

What reasons did they state for seizing the car?
Would you be able to share your experience so we might learn some more?
TOP TIP: DRIVERS. Save money by putting much larger wheels on the back of your car.
That way you will always be going downhill, thereby saving on fuel.

Ok.. It's a de-registered old banger of a Hyundai Accent 1.3i worth about the square root of **** all. (but in good roadworthy safe condition)

I was infact taking it to weigh it in at the scrap yard, when blue lights of an ambulance came on behind me. I pulled over so they could get past, however the spot I pulled over wasn't wide enough and the car became stuck on a slight muddy incline sloping away from the road.

The ambulance crew returned and said their emergency had been stood down (yeh right), and they called the police who subsequently seized the car because it has no TAX, MOT, Insurance or even a spare tire. The cop was one of those rare nice guy cops, he was very polite and I gave him all the information he requested, and even shook his hand at the end. Since he was such a decent respectable person, I refrained from dropping the treason hot-potato on him, just didn't seem right.

Anyway I've got a seizure notice here SECTION 165A-C ROAD TRAFFIC ACT 1988

It says I've got 7 days to present proof of insurance to them or they can sell/scrap the car.

I'm not in the slightest bit bothered what they do to the car, however I am going to seize this opportunity to fight back using the information presented by Dean Clifford.

Here is a first draft of a notice I have crafted based upon his description of how the system works;

NOTICE OF UNLAWFUL SEIZURE


At 10:18am on 12th of January 2012, the privately owned conveyance bearing the identifying mark “HVY MTL” was seized under SECTION 165A-C of the ROAD TRAFFIC ACT 1988, on the A470 by members of NORTH WALES POLICE.

It has apparently been presumed / alleged that;

1) I am an agent of the government bound and compelled by the legislations of Parliament.
2) As an agent of the government I do not have the right to travel without let or hindrance upon Her Majesties highways using my own private conveyance.
3) That my private property is forfeit for failing to comply with the legislations which compel performance of agents of the government.
4) The government has the right to sell or scrap my private property if I fail to prove that I have met with the rules required of government agents under the ROAD TRAFFIC ACT 1988.


I hereby give NOTICE that

1) I am NOT an agent of the government and I was NOT acting as such at the time of the seizure.
2) It is my understanding that as a private citizen and a subject of Her Majesty, I have the right to travel freely upon Her Majesties Highways without let or hindrance using my own private conveyance.
3) It is my understanding that my private property must be returned to me in good order or it may be deemed to have been unlawfully seized.
4) It is my understanding that the Government does not have the right to act as if I am an agent of the Government bound by its rules, nor to seize my private property under legislation which is binding upon it's agents, and only it's agents, without being able to produce proof of a binding lawful contract proving my consent to be compelled to perform, signed by both parties.

Furthermore I give NOTICE that

Should my private property be returned to me unharmed within 14 days, I will not seek any form of damages or compensation for having been hindered in my right to travel freely, and in having my personal private property unlawfully seized.

Failure to return to me that which is rightly mine, namely the private conveyance bearing the identifying mark “HVY MTL”, within 14 days, or to respond in substance to this notice, will taken as insistence that the above presumptions / allegations are correct whole and accurate, and that proof of those claims can be shown, and that my understanding of the matter is incorrect / faulty.

Furthermore I give NOTICE of the following fee schedule which shall apply should my understanding be correct and accurate and should the Government fail to offer rebuttal thereof.

1. For failing to return my property to me in good order within 14 days, or if the property in question is sold or scrapped;

£1,000 compensation for the loss incurred.

2. For bearing false witness against me and attempting to fraudulently act as if I am an agent of the Government subject to the legislations of parliament, and or attempting to mount charges against me as such without being able to present proof of such claims.

£2000 to settle out of court.

3. For proceeding to take the matter before the Magistrates;

£1000 per hour or part thereof for my time wasted in the Magistrates court

4. Should I be required to take the matter before a Crown Court for settlement

£5,000 per hour or part thereof for my time wasted by this matter in the Crown Court

5. Fee per each letter / notice issued after this one

£500

6. Failing to respond in substance in timely fashion to this or any subsequent notice, and thereby forcing me to pursue the matter through the courts.

£5000 + any and all expenses incurred.

7. Failure to pay the above fees within 14 days of activating them by your actions in this matter

£1000 per each day the payment is late + any and all expenses incurred in recovery.

I will check back here frequently to see if anyone has any suggestions/ideas and to post any updates on the situation.

We know of one success in this field of endeavor si, after having his car seized but refusing to sign any doccument pertaining to that seizure and subsequent notices sent to the relavent police force informing them of the fees they were incurring by keeping said vehicle. They were offered their car back without proof of insurance or tax as long as they signed a 'bailor' release form. After much head scratching we realised that this was an attempt to defer the fees incurred by getting the owner to agree he was the bailor or lender thereby making the police bailee or borrower. As far as I am aware the car was returned. The person involved was reluctant to sign anything but we worked out that this small piece of paper would be a legal doccument proving his OWNERSHIP of this car. So I believe he accepted this compromise. Would suggest it is definitely worth refering to the police as the bailee in this matter, gives an out that still saves face.

May I enquire as to what you did to `de-register` your car?
I ask because what I have done is fill in the V5 export slip for mine and send that off- that was done mid Feb 2011.

In regards to Dean Cliffords information- does he mention asserting yourself into the position of Office of the General Executor and how to create a public record for your estate so you may lawfully have your instruments/documents recognised in the public? - I believe this to be vital in getting `them` to recognise your `private` deed(s) poll.

Si,

You are aware that we all have been given the opportunity through voting to nominate MP's , you are giving 'consent' for your MP to run this country on your behalf we can also decline to give Consent in which case you can insist on not being subject to their acts, statutes and any further subsequent County Court action will be subject upon your request to the use of common Law of this land.

In county 'Court' otherwise known as a game all charges, claims, costs are balanced with what is known as 'Reasonable' and your charges by what I see and what the courts will consider are not reasonable.


If you can submit your signed sworn Affidavit ( the one sent to queenie through Tpuc ) to the Courts stating your position this again may help your cause .

You are aware you are only the Registered keeper Not the Owner of the vehicle thats how your vehicle can be confiscated scrapped .

Was your car not positioned on private land other than the public road just a thought, you are taking on a lot here keep it going though


Don't understand when you said the ambulance crew informed you their emergency call stood down so the ambulance came back to you I never been that close to an ambulance for them to speak to me at all.

Don't forget to mention all this Stress and Alarm this is having on you
Don't forget it is your Human Rights to be heard, listened to.
Don't forget the mental torture this is brought upon you and as such will effect on your ability to defend yourself
properly.

Should anything come out in the Court / hearing you do not understand Tell them it's in your interest to say this because they will assume you are keeping up and You know where this is going When you do not.

Anyone knocking on your door other than queenies heavies you can insist on them making a appointment even do them for trespass.

Finally if this goes the distance take a bible and swear on it it looks impressive in court

Does section 12 of the Bill of rights apply here?

that no fines or punishments shall be imposed without first having a trial by jury/going before a judge (or something like that, lol)

I'm suspecting Dean Cliffords stuff isn't from his own ideas- not that it is wrong, because people can add experience and ideas to the pool.
