Is all this FREEMAN, FEE SCHEDULE etc stuff really TRUE?

In July last year I went to the Mag court over a speeding offence which I found out was illegal due to insufficient road signs and markings. The clerk of the court read out my reg number incorrectly and I quite rightly denied ever owning that vehicle in the past or presently. They then turned to the magis and said oh sorry your worship it's a typing error and corrected it and read it out again. The paperwork they had sent to me had the wrong reg number on it too. They only got the correct reg when they asked me to confirm it. I presented my evidence which was photos showing the insufficeint signing etc but they just took a quick glance and found me guilty. They fined me £65 with £60 costs and £15 victim support which I questioned and asked who were the victims? No reply was given I was just ignored and the mag asked me how I would like to pay. I replied never and to this day I have not paid a bean. This is due to follow up letters to the court. My guess is they have deliberately made these mistakes on your paperwork HVYMTL to allow themselves an escape route. Instead of a Freeman claiming a victory they can say it was due to an administrative error.

But how can I utilise this escape route?

I'm sure that they are going to find me guilty, it's pretty much a foregone conclusion... so what then?

Wait for the Notice of Charges and send a conditional offer. After 7 days if you haven't heard anything then follow up with a Notice of Non Response and claim permanent lawful estoppel by acquiescence. Templates can be found on the net I'll point you in the right direction if you need it.

And that comes after I get 'convicted' by the court right?

I've only been through this sort of thing once before so it's kinda hard to remember the sequence of events.

Yeah but don't enter any plea guilty or not guilty. Remember innocent until proven guilty, it's up to the court to prove you are guilty of the offence as charged. If they have your name wrong on the charge notice then that could be one of the reasons you are sending them the conditional offer of acceptance ie on proof that you are that person.

Arn't they going to ask at the start of the hearing how I plead?

Last time through, I ignored the first two hearings, nearly got arrested, and then finally only went when they had already convicted me.

You have the right to remain silent. Let them go through their pantomime act but just refuse to consent to their jurisdiction. You have the right to a trial by a jury made up of your peers.

I think that would all come under your affidavit and claim of rights. Have a search and you'll find templates somewhere.

They won't care about any of that stuff, if anything has become clear to me it's that they do not care about the law unless they can use it against you. Consent ought to be the most important principle but at the end of the day they won't give a damn about it, they will find me guilty, fine me and if I don't pay they will send bailiffs around. If I didn't have to consider the effects that would have on family I would tell them and their bailiffs to go f*** themselves, because I know that bailiffs can't break in and we have already secured the doors so that they can't use locksmiths either.
