i agree with your post. so i worked out, its another company to contract with them dwp ltd, i wrote prove i need to re- contract too be required too have a atos medical, as i do not give comsent to contract to atos ltd staff either, this worked as i had letter saying my transfer to esa, is done and no medical and ion support group, yet they failed to make clear i ment to get higher rate on top, so my letter head office london dwp legal department, asking for this to,

If you haven't seen this this has the actual contract between ATOS & DWP (2 private companies - someone I know used to work for DWP and it was actually referred to as a 'company') and has a list of conditions for which you shouldn't even be asked to attend a medical.

Medical Conditions and Categories

For the purposes of administrative scrutiny of cases to determine suitability for inclusion in the DLA in Medical Examination Centre project, 5 categories of case have been devised:

In 2005 the Welfare Reform Bill, which introduced the Employment and Support Allowance (ESA), had not yet been enacted hence the reference to the Disability Living Allowance (DLA).

1) Unsuitable for calling to a Medical Examination Centre.

2) Reference to Medical Advisor required for advice.

3) Tentatively invite to Medical Examination Centre.

4) Invite to Medical Examination Centre.

5) Any other Diagnosis.

For each category a list is attached.

1. Unsuitable for calling to a Medical Examination Centre.

What about having more than one ailment in the Invite to Medical Examination Centre section?

I have a dear friend who is usually pissed as a newt and he has Alcohol addiction, Asthma, Angina, Back pain, Depression, Hypertension, IBS, Joint Pain, Panic attacks, Personality disorder, and a tendency to want to hug and kiss you as the best in the world! He probably has more ailments but hasn't been further diagnosed as he now refuses to go to the doctor because of all the "bad news"
Laugh my friends even if it kills you, for at least you'll die happy

everything is "IMO" if you want to argue ring your local jobsworth council officer...they love it..

Okay going to try to keep a level head and bring information that I have learnt today.....outcome of my appeal at Tribunal was that it was disallowed.

Going to be polite and exclude expletives :D

So facts are that even though your doctor has confirmed that you are unable to seek employment due to illness you have been told by the hierarchy that you are fit for work.

Anyway this is for anyone going through this situation and I would like to share what I learnt today.

To start - if you sign that you are “not fit” to seek employment (because your doc says so) – then you cannot sign up for JSA.

If you wish to contest the appeal at Tribunal decision then you can appeal to the Upper Tribunal. Before doing this you firstly need to apply in writing and request a statement of reasons for the Tribunals decision (as you won’t be given this beforehand). Bear in mind that you cannot claim ESA whilst appealing to the upper tribunal.

You can of course... make a new claim immediately for ESA – “IF”- you have a new illness. Check out your original claim. If subsequent illnesses have proceeded because of your original illness then a new claim can proceed.

If anyone is going through this experience I am more than happy to share any knowledge I find.

This is simply about getting the benefits bill down and nothing more,just another attempt by the Tory government to screw over the poor and most disadvantaged.

I feel that all DWP medicals should be recorded audio/visually if the person being examined wishes so, but this won't happen. I was subject to a DWP/ATOS medical after a serious spill and the ATOS doctor lied through his back teeth. I took it to a tribunal and wiped the floor with them. At one point, the DWP's rep was actualy arguing with the DWP doctor and almost telling him he was wrong. This doctor really got the hump and it was funny watching them thrash it out.

Even after I won my case and retrieved a shed load of points back, the DWP still tried to prevent my return to my original position by lying to me over the phone, telling me that Gordon Brown had changed the law. These people must tar everyone with the same brush in thinking they are thick. I feel for those people who haven't got the intelligence, education or courage to be able to fight against this monster and sites like this are a great source of info for them. Way to go to all those who give up their time here to help others who are struggling and especially for Leagle Eagle who could be like a lot of other legal professionals in their snootiness.

I just got a letter this morning off the DWP telling me that my ESA has been stopped after a recent medical examination at Atos found me fit to work. At no time did the interviewer examine me and as I understand he was not a medical professional which he pointed out to me at the start of the interview. Atos are a French company operating for profit and are paid on results,ie the more people they can get off the benefit system the more they will be paid. Surely it's a bit like tellin a copper the more people you arrest the more you'll get in bonuses, what do you expect him to do?

It works like this: If you are totally paralised and all you can do is lie down and blink your eyes then you can do computer work...... :lol:
