Without predjudice

Postby Noisytone » Mon Feb 06, 2012 9:29 pm

Hi all ,

Ive seen quite a few templates regarding notices etc on different forums and i have seen that if you use without prejudice its not considered evidence that can be used in court im sure someone will be able to clarify it but this seems to be the general opinion . Just thought id pass it on :D .

im no expert but i thought that if you put without predjudice along side your signature it means that you have not lost any of your rights by signing so say if you were but in a position were you had no option but to sign something you can then claim you right to have it heard under common law using ucc 1-303 ,i think ive got the number wrong but a bit of home work should enlighten you

Garner's Dictionary of Legal Usage.

Definition of 'without prejudice' say's;

without prejudice (= without loss of any rights) is peculiar to legal JARGON. The phrase describes a legal action - either judicial or among private parties - that in no way harms or cancels the legal rights or privileges of a party. The antonym is with prejudice. See Prejudice.
