Star3t, I dont see the problem you have posting this letter stating why it is unenforceable, as whitebakecase says:

After being asked if i would agree to see a 'work psycologist' (sp) and being told many times that i did not have to see her and that they (jc) , could not make me see the ws , i declined the offer . I have now been told that because i refused , i will be placed on mandatory work placement unless i agree to see the work psyco !
Not sure when i get measured up for the leg chains , i was told it would be in a well known charity shop , is this for real ? Looks like i am not the only one for the work camp ! Arbeit macht frei !

Just to update everyone,well I was down to do the MWA at Oxfam but I e mailed them and asked if they was participating in the MWA programme as I had seen on the news they was not,they got back to me and said that I was NOT to attend the placement as they was NOT taking part in the scheme.
So this is where it gets interesting,I then contacted a4e and told then I was not going to Oxfam as they are not in the scheme and that I would be contacting my MP to get to the bottom of this which I did.
Well that defo got the response from a4e and they said we are so sorry there appears to have been a mistake and of course you dont have to attend at Oxfam after all surprise surprise ;) anyway my MP wrote to their C O and they shit themselves,they phoned me on numerous occassions saying how sorry they are AGAIN and gave the usual bullshit.... but I still ended up at the British Heart Foundation and they are a the pits,all we do is move furnuture and stuff around the store,NO training and not even any safety footware or gloves.Its all a complete waste of time,nothing I have done has been in any way going to enhance my job prospects.

Hey mizz, thanks for that update. The Work Programme is mandatory but you could consider using one of the 'good cause' clauses for not having to participate - this is s snippit from the new regs below:
‘Good Cause’ for Failing to Participate
70. The Committee and a number of respondents raised concerns about the way in which assessments of ‘good cause’ for failing to participate in the scheme would be managed. Unlike previous sets of Regulations, the Regulations establishing the Mandatory Work Activity do not contain a list of criteria that would automatically be considered ‘good cause’ for a failure to participate in provision. Instead they state that an assessment must be made of any potential good cause, and that particular account must be taken of the customer’s physical or mental health or condition. 71. By prescribing a list of circumstances that would be taken into account as ‘Good Cause’, previous sets of Regulation have risked limiting the circumstances where Good Cause would be applied. By including only physical or mental health or condition, these Regulations leave Jobcentre Plus maximum scope to consider all circumstances and establish whether there was ‘Good Cause’ for a customer’s actions. Jobcentre Plus will still take into account all of the factors that were previously part of any assessment of a sanction.

What do you think to this method. I have not voted never have never will. Therefore I have not given any consent to be governed. Now we can use the Jobseekers Act 1995 against the DWP / Jobnasty as their coroporations and are obligated to comply with statutes however as I have not given consent when they state you have to go on this (waste of time ) Work programme under this section of this act it makes it manadory. Act therefore do not applie to me so unless they can prove their claim as to they do apply to me or that i have contracted with that ACT.?
