Unlawfully Arrested

Postby >andy< » Sun Apr 01, 2012 11:43 pm

Hi everyone who's reading this!

On saturday afternoon after a football match i witnessed protesters outside the ground being "hasstled" by police.. I thought i'd go over, help out and remind them of the oath they took etc.. (as you do)
Now the most senior officer gave me his first name and spoke to me on a "level" we discussed issues etc (as you do).
Now another bobby was abit hot under the colar with myself, The senior memeber aknowledged i was educated in such fields where as the others believed me to be talking shit

Anyway cut a long story short, i end up arrested - Hand, Shoulders & back bruised from the force they put on me.
I made it clear as soon as i was arrested that on and off the record i wouldn't resist this arrested neither did i give them any reason to believe so.
I was thrown into a van face down, pulled out and took to a holding cell within the ground.
After the process, i was then transferd by a big wagon to a police station no more than 20miles away from my area.
All along the way - I made it clear i was going to protest this arrest in a peacefull mater.
On reaching the police station where i was to be processed, i made the desk sargent aware of my understanding of the situation and made him aware of what i was about. I told him that there were no complaints bought against myself, i didn't stand under his authority etc.
Within 20mins of being in the station - i was released without question, no charges were bought against me... I didnt even have to give my name or sign anything.
Now - they wanted me to sign everything and anything ie. getting my property back to which i replied i never gave you permission to steal these things. I quote various rights throught the procedure and basically i was told to get out the station.
Now, after being escorted from the building in the manner i enterd - I went around the front desk and demanded a senior officer to come to the station. He arrived within 10mins after i made it aware of what i was about.
Push comes to shove - The senior officer drove me home personally 20miles into a different county.

Now, i don't want to let this blow away in the wind. I've been seriously assulted by the officers who started this off.. I have buises all over my wrists shoulders and back.. even my knees are scraped up.
Baring in mind i said "on and off the record i would not resist any arrested" neither did i show any signs of it.

Is there anyone out there who could possibly point me in the right direction of taking this to the next level.. I understand the IPCC is an option but i would like to send letters in true TPUC style

I was arrested alongside another fan who was basically under the same thing as me... He was released 5hrs after me with charges bought against himself. After speaking to him, he said "you were making the most noise yet you were let out first"

You know why that was don't you.

thanks everyone

good advice given but did you go to hospital or you gp to take note of your injuries ....only for future backup just in case
theres a few routes you could take but me personally i just like to keep me head down and act when needed then as you have got away with it learn and let it go and use your experience to help others along the way ..think about it this way ..is there anything that you said or done that you could of handled a bit better or not if so learn from it then the next time if any you handle it better than the first time which is better for yourself
i went out of my way to get pulled by the enforcers just to try something out and it worked, this time but would i do it again ..possible not...but i know i will handle it a lot better the next time if needed :)
OF COURSE I TALK TO MYSELF..sometimes i need a professional opinion

The reason why i was released is because i stood up for what i believe in, it's on the record i've done nothing wrong. What you're saying is do totally the opposite to that? hmmm

I've been into the police station today, spoken with an inspector. He fully backs my claim for remedy.
I'm now awaiting a meeting between myself and the accused officer. All this is part of the process.

Yes it does seem the advice you have been given on here doesn't really deal with the question you opposed about taking it further. It would seem what you are doing is the right action, if you were arrested for nothing and then released with no charge, then you of course have the right, like anybody, to complain about the arrest or detainment or whatever it was they used to take you off the street for the time they did. Im sure the police would also tell you this is the step you should take, and that seems to be what you were told by the inspector.
Laugh my friends even if it kills you, for at least you'll die happy

everything is "IMO" if you want to argue ring your local jobsworth council officer...they love it..

i'd like to point out the mention of going to the hospital/doctors and getting a report.. Good advice, and i have done. Anyone else in the same situation should do this before anything.

Don't know whether this is possible but if successful it may make a big difference to the way police officers rough handle people in future. You have recieved a personal injury so talk to personal injury solicitor i don't know whether your bruises and such would be worth much and most of personal injuries cover the loss of earnings. But psychological truama is in many cases worth more than the physical injuries, you do have to prove to an independant psychologist that you are suffering. (symptoms available online)

I went through personal injury claim when my employer destroyed my feet, i was working for a huge corporation and my solicitor absolutely loved hammering such a big pretentious company as them. If you could get a good solicitor maybe they could do it for you, post truamatic stress can be worth around £46,000 in these cases.

The main thing though if a police force is having to pay out large sums every time an officer gets a bit rough that force is going to tell its officers to be a little more sparing with the brutality.

PACE guidelines state reasonable force should be used in the arrest and detention of a person. Police are renowned for getting a bit rough when large crowds are concerned. Police complaints commission is a good route. Also talk to your local councillor and get them to raise concerns for ypur treatment. The re will be a record of what you were detained for so maybe a section 7 full disclosire request to the arresting police authority. They will charge you £10 though.
