Just over two months ago i was out delivering in my works van. I had my mobile on speaker phone laying on the dash. I pulled up opposite my next drop, then picked the phone up to end the call. While doing so, a plain car pulled up on the opposite side of the road and a uniformed officer approached my van. He proceeded to tell me not only had i been on the phone whilst driving but i wasnt wearing a seatbelt and had a brake light out.
He asked for name and address after taking the companies details down as well and told me i would be going to court. I asked why would i be going to court instead of being issued with a ticket there and then but he just said because your going to court. So i never signed anything. i never even admitted to what he was saying, i simply said ok as he gave the usual spiel, and gave my details. i have since researched about having mobiles on speaker and found that it is in fact illegal if its not situated in a shop bought holder. He then went on to call my boss the following monday), and i figured that as i wasnt issued an FPN it probably wouldnt go any further.
Two months on...i receive summons as promised....great.
The summons states that im only being charged with the mobile " offence" but he has mentioned giving me a warning for the other two.
My initial re-action was to go guilty by post and accept the 3 points, i now have a hands free kit so it wont be happening again. But ive since read that you can get fined up to £1000 for this "offence" if it goes to court instead of being dealt with by a fpn. Why has it gone to court when it could have been dealt with by a FPN?
A few people have told me to turn up and plead not guilty as there wont be any photo evidence and chances are the sergeant wouldnt be there anyway.
What reading can people recommend to me?I found the site a few years ago but have had to re-register so im not a complete newbie to this.
